Administrative Review Tribunal (ART)
The Administrative Review Tribunal (ART) is an independent body established to review decisions made by Australian Government agencies, departments, and ministers. It commenced operations on 14 October 2024, replacing the former Administrative Appeals Tribunal (AAT).
Role of the ART:
The ART reviews a wide range of administrative decisions, including those related to visa refusals and cancellations by the Department of Home Affairs (DHA). Upon review, the ART has the authority to:
- Affirm the original decision, meaning the decision remains unchanged.
- Set aside the decision and substitute it with a new one.
- Remit the decision, returning the matter to the original decision-maker (e.g., DHA) for reconsideration with specific directions.
Time Frame for Lodging an Application:
If you receive a decision from the DHA regarding the refusal or cancellation of your visa, the notification letter will specify the exact time frame within which you must lodge your review application with the ART. In most cases, this period is 28 days from the date of the decision. It’s crucial to adhere to this deadline, as late applications may not be accepted.
Processing Time:
The duration for the ART to assess and decide on your application can vary based on the complexity of the case and the documentation provided. It may take several months to reach a decision.
Bridging Visas:
Upon lodging a review application, you may be eligible for a bridging visa. The type and conditions of the bridging visa depend on your specific circumstances at the time of your original visa application.
